These coveted spots are then resold at inflated prices, in what constitutes an underground market for sought-after dining experiences.
I recently spoke with one of our high-profile restaurateurs about this issue. Shockingly, up to 30% of their tables are being fraudulently reserved, leading to a significant loss in revenue. To counter the uptick in fake reservations, they've resorted to taking inspiration from airlines and overbooking.
While this strategy can potentially mitigate the issue, it imposes a heavy operational cost on already stretched and stressed operators. The logistics of effectively managing overbooking are not trivial. Airlines spend vast sums of money on predictive algorithms and logistics experts to perfect overbooking and still struggle to avoid bad customer experiences.
Realistically, restaurants don’t have the resources to match airlines. This means that a majority will ultimately struggle to consistently provide a good experience by resorting to overbooking.
Even more concerning, advanced technologies like voice cloning and automated phone calling further exacerbate the problem. According to the restaurateur, they revealed that they’ve detected voice AI-powered bots calling restaurants and booking reservations directly with the host, bypassing online booking platforms and causing further disruption by tying up valuable staff time.
Our customers are resorting to implementing their own “human tests” – training hosts to ask qualifying questions on calls to check if the caller is human or not. A clever strategy with an unclear window of effectiveness, as fraudsters constantly monitor their bot conversations and retrain them. Why Legislation Can Only Solve So Much Recently, legislators in New York proposed the Restaurant Reservation Anti-Piracy Act . The legislation prohibits third parties from booking unauthorized restaurant reservations with food service establishments and specifies fines for these violations.
This legislation is necessary and a step in the right direction, offering a framework to address reservation fraud more systematically. However, it’s hard to speculate the extent to which imposing penalties and fines will act as a deterrent. Just as much as mitigating fraud is expensive, the same is true for law enforcement to pursue such investigations.
Legislative action alone has limitations and must be one part of a more collaborative approach. Laws can set the stage, but enforcement and ongoing vigilance on all sides are necessary to keep up.
Weighing Potential Solutions The truth is that bad actors will always try to profit from that scarcity. A collective effort, including tech companies, reservation platforms, and government agencies, is a must.

While this may effectively drive off fraudsters and reduce no-shows, today’s guests want convenience and ease but expect their reservations to be honored without hassle.
